From my experience, this guy's attitude is actually pretty typical of Bama fans. For some reason, because their university's football team is better, they have a sense of personal superiority. I absolutely hate it when Bama fans come toStarkville. I think they are by far the worst fanbase in the SEC. I didn't watch the video because I have no desire to see that, but I saw the still pics where the guy was flipping the LSU fan off. You can tell by the look on his face that he is looking at the LSU fan like he's a piece of ****.I think sometimes, it's all they have. I was shocked to find out this guy actually attended Alabama and was not just a sidewalk fan. (Note that I grew up with a lot of sidewalk Bama fans and have a deep hatred for them).

When we beat a team, I don't look at their fans like they're ****. They just happen to pull for a different team, and their team lost. Bragging rights is one thing, but their fans seem to take it to a different (crazy, violent redneck) level.

The fact that some people are dismissive of what this guy did is crazy. Maybe this goes back to the "greek or not" poll from a few months ago, but I would never find it acceptable for a dude to rub his junk on me, much less a stranger, in public, on video.

I agree that a better ending would have been for the LSU guy to beat the living 17 out of this guy. But this kind of **** isn't acceptable. I personally think the guy should do some jail time. As far as being a registered sex offender, I've known people (because of my line of work)who did less egregious things and ended up on the list. Think about the thought process: "This guy is an LSU fan. He's unconcious. I am going to pull out my genitalsIN A 17ING RESTAURANT and put them on this guy's face." That's (at best)some borderline sociopathic behavior. Being drunk is no defense. It might do this guy some good to have the justice system smack him around.

I was thinking that clause was written to protect the mentally and physically handicapped, but figured you would easily slide a passed out person in there since they have no mental or physical way of defending themselves. I guess that's where the DAs interpretation and mood comes in deciding the extent of the prosecution.

Hopefully it will be just a few months, fine, and probation as you said. He's already lost his job. I'm sure his will be leaving him soon as well. This dude's life is over - I doubt he will be up to his idiocy again...

I see a very large settlement my Krystal in the victims future.
They also have a duty to contact local police and emergency personnel when you have a customer passed out in the restaurant.
If you watch the video you see several employees just standing there, doing nothing. I expect that manager to be fired, if they haven't already.

I'm also surprised there isn't a security guard or something there. Hell the Starkville Waffle House had (has?) one. Why wouldn't a Krystal (drunk magnet) on freaking Bourbon Street (drunk capital of the western hemisphere) have one?</div>

Plus, the Bourbon street Krystal is like 200% more expensive than any other Krystal I've seen. Enjoy the ambiance of Bourbon St. and just buy yourself a damn hot dog...

Just because some of us do not think its sexual assault, does not mean we think it's not a crime, 'acceptable', or just a prank.

I did compare it to pranks earlier, but I also stated I think it's criminal, because it is a step past writing on someone. Like I said earlier, I don't see a difference between this and pissing on someone. It's a crime, but it's not sexual assault. I see it the same as if he stuck his foot on his face. Some people are just so homophobic that they aren't thinking.

Bottom line, do you want a 'real' criminal released early so this guy gets prison time? Me, if it's a first offense, just give him a large fine and probation.

Some of you old farts dont realize this is a common prank on college campuses these days. Not that that excuses it, but it's important to be smart enough to realize he almost certainly was thinking of this act as something that would be 'hilarious', not as something he could get off on and pass off as a prank. Intent does matter. Let a murderer or mugger etc take a cell, not this guy.

Dropping nads on the guys face could be played off as non-sexual. Simulating a sex act by imitating sodomy on the victim with a bare scrotum is going to be very hard to get away from. Ironically that's far less offensive than getting a sackto the cheek.

(And although didn't get a composite 34, I did on 2 sections. I was still drunk when I took the first two sections. Damn Ezra Brooks whiskey)

If you commit a crime, it doesn't matter if you intended to or not. Drunk drivers get convicted for manslaughter all the time andfew of them ever intended to hurt anyone. The simple fact is, there is nothing for anyone to stand on to argue that isn't sexual battery. There's video evidence. Wouldn't take a jury an hour to convict. If you guys want to do that **** in your dorm rooms or frat houses, go right ahead. Just be aware that if someone gets real pissed off about it and videos it, you could be in the cell next to this guy.

That said, I don't think there's any way this guy needs to get 25 years for this. They need to plea bargain it down to a lesser charge, but he's going to have to do some jail time. And yeah, his life is ruined. Some of you guys defending him need to think about that. Because it really could happen to you.

The guy in question is an "old fart" too at the ripe old age of 32. He's not in college and hasn't been for a while. He doesn't know the person he did this to. He was not on a college campus. He was in public in a fast food restaurant. When was the last time you saw a stranger play a prank on someone at a fast food restaurant?

Question for you. Would it be different if the guy drunk had been a woman? BTW...this question is a trap.

NO ONE deserves to be assaulted by another's genitalia regardless of race. Yeah, it sucks a prank went wrong, but as soon as that guy whipped it out, he crossed the line. How would you like it if another man whipped his johnson out and rubbed it on you thinking it was funny? You'd feel violated. That, my friend, is sexual assault.
Good gosh. It's amazing how difficult some of you have seeing how this is assault and not a prank. Yeah, it seems funny at first, but it ain't.

1) You don't have to make a 34 on the ACT to know that foot does not equal testicles. (Further, the law views the two differently. Unless, of course,the Bammer stuck his foot into"Sam's" butthole or in his crotch--that would be sexual contact). Foot touching nonsexual part= completely nonsexual contact.

2) I'm not homophobic in the least. That does not mean I want a dude's balls on me. I wouldn't want some nasty, trailer parkBammer **** in my face either.
