How about drinking for my state with bulldogs getting trashed hanging from the letters. Saw one of those in St Louis for a group of friends with the Cardinals drinking and hanging off the bat.

Use the 1960's/1970's apollo M logo. Or the Felker style MS logo. Throw it on a Comfort Colors shirt and market it as "vintage" and that thing would sell like hot cakes.

Hey thats me! ya like everyone has presumed we may have a problem with using those logos. I am going to give one to Jonny and we should have a photo of it but I'm not going to cause any trouble to try and make these unless there is a trademark lawyer on the board that could give us advice in going forward, last thing im going to do is take away $$ from MSU, Lord knows we need it but id love for them to give the greenlight on something like this. I tried to buy one from that site you originally linked to in this thread last week. Placed an order, paid, and all. Two days later the company calls and says no dice due to licensing such and such with the school.

Is it legit this time? Because I want one of these damn things.

I hope so. The same thing happened with me. I can't promise that the same thing won't happened here. It's real tricky. I ordered one from Zazzle.com and actually got it, but when I tried to sell it they wouldn't allow me. I now think it was based on the tags for the shirt I had listed. So with Cafepress I didn't use any tags that would set off any signals. If you do order and get it, please let me know.

With the logo being altered, it's an easy argument for legit fair use. However, depending on how you identify the product for sale on the shirt websites, their flags will catch it (bc they are designed to prevent infringement). I think that's his only problem.

They would have to get licensed through our Licensing Resource Group www.lrgusa.com - and then each and every design the licensee wants to produce has to be submitted for approval by our office....

But I can tell you this design is not likely to ever be approved by our office. And if anyone were to print these and try to sell them, we would have to send a "cease and desist" letter to the individual/company

As long as there is nothing on there that is a trademarked logo or verbiage or the name or nickname of the university, etc. - You can look at the LRG website and see all the trademarked logos, verbiage, etc.

I'm not sure if it's still considered licensed by the University since we got all new logos recently. Could be worth looking into.

ETA: I know nothing about licensing.

Thanks for looking into that. I figured that was the policy. I'm going to leave the shirts up at the link I posted earlier until they say something. So get it while you can! If any one comes up with any other ideas let me know. As far as reworking the image using something else, I'm not sure it's worth it. If we were to use something else that wasn't licensed I think the whole thing would be lost in translation.

T-Shirt Sale Update

Alright, sorry guys but it doesn't look like it's going to work on the link I provided at CafePress. I just logged in and saw that they were flagged. I didn't use any tags or description that would lead to MSU, but I guess they're looking into the image. If anyone tried to purchase and it gets denied I apologize. Looks like there's no real way around this right now. Damn, oh well.

I think you would definitely need to remove the M-state logo from the background, because it is definitely trademarked and not altered.

You have altered the trademarked bulldog logo for satirical purposes. So (1) you aren't using the trademarked logo, and (2) even if you are, you are using it in a clearly parody-type manner.

I think you're covered by fair use, but if they want to fight you over it, you're gonna need a lawyer and just hiring one would be pricy. I am sure you really don't want to fight like that over one (hilarious) tshirt design.

That said, if they send a cease and desist letter and you comply, I doubt it would go any further. So there's that, if you can find anyone to print them.

I believe that after these alterations there is nothing in this image that could be claimed copyrighted but still maintains the MSU fill to it. What do you think about this rendition?

I done some Hail 17'n State shirts on Zazzle and they passed and are still in my store...as well as Dak Attack shirts..ha. I guess you have to find the loop holes.
