McGregor denied access to tapes

Just to give you some more information about what the FBI has in their possession that Uncle Miltie wants:

A federal judge today denied <font color="#305cb6">Milton McGregor</font>'s request for <font color="#305cb6">access to federal wiretap</font>s and other evidence in the case against him, saying the discovery motion is premature.

McGregor, who owns controlling interest in VictoryLand, was arrested Monday along with 10 other gambling operators, legislators and others. His lawyers on Tuesday filed the request for the materials.

"Delaying his access to these materials would do nothing more than give the government an inappropriate trial advantage, a trial-by-ambush," lawyers for McGregor wrote.

A federal magistrate judge said the request was premature before McGregor's arraignment Oct. 15.

"Any motions for discovery prior to that time are not yet ripe," U.S. Magistrate Judge Wallace Capel Jr. wrote.

Everybody's been wondering about the timing of the Cam stuff coming out. Let's say Milt didn't get access to the wiretaps (which, up to that point, had nothing to do with Cam) until after Oct. 15th. Once he did finally get access to them, he'd surely call the powers that be at AU and tell them that there's damning evidence out there in the form of him talking about paying players. It just takes one journalist to catch wind of the words "money" and "Cam" to start digging, and all of a sudden, mid-season, this stuff starts surfacing...

Of course, this is all just pure speculation..

...The FBI isn't going to just hand the NCAA stuff that they aren't going to hand over to Milt.

Once they start indictments they are done. They can't withhold evidence from the defense or their case will be thrown out of court. Don't you watch Law & Order!?

From what I understand : These 'things' we are interested in could have possibly been outside the scope of the warrant authorizing the wiretap. The FBI may be involved because they are looking for OTHER evidence to corroborate the info from the wiretaps on illegal solicitation, which would be admissible. As such, they may give information not pertinent to their investigation to the NCAA. Odds are, given the situation with mcgregor, etc, it is likely that the bribery trial will be moved to another district, so the FBI will have to be careful sharing evidence before then, as doing so could prejudice a jury pool. It is interesting because of the FRI arraignments -at that point, defense counsel is able to get discovery and FBI can redact all info not pertinent to trial and send it to outside source, such as NCAA.
