New Transfer Rule!!

Big problems and it was passed and no one knew it was on the table! What happens when an LEA don't sign off on the transfer? Is there some kind of appeal process?

I expect there is a reason this came up. Most likely they are getting heat from legislature or they have been told there is a potential lawsuit or some type of action that may not go in there favor if pursued. I say this because the NCHSAA has always been very against this. With Forsyth County allowing the transfers it may be a way to allow that and appease other systems. Remember, just because the NCHSAA allows the local systems are not required to participate.

My take is that Charter Schools with NO district lines will greatly enhance their ability to win championships in every sport now, including Football....Also, kids can now transfer within their own Counties to a pubic school that gives them a better opportunity to win a state title in every sport without being penalized by having to sit out a year.....

I think we may just see the end of Public Schools winning or competing for a State Championship in several sports, especially basketball....

Will be interested to see how this plays out in the coming years, and we could see the eventual separation of Charter Schools and Public Schools when playoffs begin, a lot quicker, than would have ordinarily been the case because kids want an opportunity to play for state titles, so it goes without saying that some parents of talented kids will now be more willing to move their children to schools close by that will afford their children that opportunity....

What will stop a Coach from ANY school from actively recruiting and pursuing talented kids since there will be NO transfer penalty?

In fact, A Coach wouldn't be doing his job if he doesn't take advantage of this new loophole in the transfer rule, especially if the goal is to compete for Championships!

and 2 cents well spent; the only thing I don't get is why the 360 on transfers! Recruitment city now to get a kid and as long as both LEA's agree, zero can be done....it's just odd that they set all these rules & then this

I posted on another site that this just really opened it up for magnets and charters.

The goal is for charters to eventually have their own playoff brackets although for smaller schools I think it must go a step further with magnets and parochial if they decide to allow this. I think Charlotte Catholic will not allow it for someone transferring in who lives in the area although I could see it being the fair option if the student previously attended Catholic.

I don't really see Magnets or Charter benefiting more than the traditional schools. The non boundary schools already had open enrollment so this is not as big of a change for them. The larger school systems will benefit the most. Charlotte was known for their strict residence enforcement as well as Guildford county (N. Guildford forfeited State Title). Now students will have the choice of a dozen or more schools to choose from within their county without moving. I also heard the rumblings of a few law suits against the state of NC for discrimination. The basis of the claim,Those at lower performing schools would be denied equal education opportunity unless they accepted punitive 365 rule. Which put parents in a bind do you stay at your under performing home school or transfer to a school with better instructors and test scores and sit out a year of sports when everyone pays the same taxes to attend schools in your system. Lastly the 365 rule only impacted athletes, but not other extra curricular activities band, orchestra, chorus, ROTC etc. So you could argue athletes were treated different and denied the ability showcase their talents to earn scholarships while the other actives were not punished, This new rule takes the threat of litigation away but we all know 99.99% of transfers could care less about the the schools academic standing but it is what is.

about the 2nd year in of new realignment you'll see the power teams/schools start showing up....system to system both have to agree but within the system, look out!!!

I think it definitely helps the charter and magnet schools. An athlete's family could move into another school district but under the strict interpretation of the rule that would not open them into a magnet or charter but only the home school. If a family falsified documents or changed the guardianship it still did not open the magnet or charter school option. Those two were supposed to be first day freshman year in order to not have a 365 set out. This is something I explained to Coach Gentry when we discussed charters and athletes showing up after playing at another school.

Forsyth County was already doing this now everyone else can. The Administration were cowards to pass this rule so I don't see them blocking many transfers at the LEA level, If they do they better have a darn good reason or block all of them. Just wait until Guilford, Wake and Mecklenburg counties students start using this rule (super Teams). I can see it now Mallard Creeks QB's graduates and the one from Butler or Independence fills right in. Or Page needs a PG someone from Grimsley or Dudley steps in for a big three LOL.

Meck County rarely allows transfers at all so I do not think this makes a big difference there.

I could be wrong but the way the rule is written it seems you only need approval if transferring to another LEA. The rules does not mention the process within the same LEA someone with access to coaches or AD's needs to find that out for us. I'm also wondering who in the LEA's would make that call or will everyone have to create a transfer gate keeper role, It will be interesting to see how it goes.


REVISED TRANSFER RULE
The Board of Directors heard from several committees and staff regarding potential changes to the Transfer Policy. The following will be applied to any transfers from one LEA to another LEA.
1. A student’s first transfer after initial entry into the 9th grade is not subject to the NCHSAA transfer rule, provided both LEA’s agree to the transfer. For any transfer thereafter, the student must sit out for 2 consecutive semesters (at least 50% of the current semester plus the following semester) or 365 days, whichever is less.
2. The NCHSAA Transfer Committee will be composed of the NCHSAA Executive Committee and at least one (1) non-district affiliated member.
3. Students who want to participate in cheerleading are not subject to the transfer policy, however, all current eligibility requirements would remain applicable.

I think this benefits the children. Now with sports being factored in, yes this will create some backlash but at the end of the day this allows families to have more control over the educational piece while not sacrificing the sports side.

I said this in the past when the Charter argument was discussed, It's about educational choice. It's too many possible law suits that could happen if the state did what most wanted.

The rule notes two LEAs meaning the one transferring from and the one transferring two. In Meck County CMS would make the call as they cover both which would be normal for a transfer involving one LEA. This rule is related to athletics. CMS has controlled transfers for any reason very closely for years. I had the numbers for transfers from a past year without a physical residence change after day one freshman year and it was about 40 for the over 20 schools, 19 (now 18) that played sports. Number did not include students returning to their home district school.

We're living in a new age and day. I believe the intent is for the children to benefit. Yes you do have parents that send their child to places for sports. Charters is no different when it comes to this. "We" as sports fans will always disagree with legislative driven agendas because most of it doesn't take in consideration the impact it will have on the sports. I really believe that if the state had it their way it wouldn't be like this. Best believe it's a driving force behind this and it typically rest within the politics.

The state will never make "sports" only decisions without considering what is going on around them. I put the ownership on parents. It's the parents decision to move a child for whatever reason. I think we are basically on the same page on this. Only thing is NCHSAA is not a state organization. I do believe they are influenced by political views at times.

I cannot speak for all people who have seen charters rise up suddenly in their areas. Do not want to tell others how to raise their children however have seen some move them to these schools for what my generation would consider trivial reasons on the education side. Not sure how this will help these students when they grow up and are faced with real problems that they must solve themselves.

This is not meant to be another "charter schools" bashing. Just think the new transfer rule will make it easier to build teams quickly, and destroy others, in both charters and traditional schools.Without the 365 rule many coaches, some who have never considered it before, may be tempted to put in for a recruiting stipend.

I totally agree with you. This change will build up and destroy teams. I believe the strong programs will get stronger, but the on the rise programs will suffer. For example say on the rise team A is in the same area as strong program B, what's keeping the best players on team A from going to team B.

Yes sir I agree with you. Now however travel tournaments may begin to look like a HS gym when Duke,UNC, and Kentucky all want the same power forward. May have to have a section for ALL HS coaches to sit.

OK I am being facetious but I can see many coaches trying to contact players that have told them "I wish I could play on your team". Why would you not if you think the player could improve the team?

It is bad enough around here with all the accusations aimed at one of the local charter schools, whether true or not. Going to be interesting when you throw all seven traditional high schools in that pot.

I don't think the "daddy" coaching is just a charter thing. This goes on all through football starting at pop warner. The problem I see from my view is (daddy, momma, friend of the family) shopping kids through travel ball, AAU, ect. This has gone on for years and is nothing new. Now you know it's happening everywhere else not just charters.

In many cases some programs speak for themselves. In this day and age of social media families know exactly what many schools have to offer. Some programs recruit themselves and attract families. Say team A is known for (winning or sending kids to the next level) and team B doesn't do either. Guess where I'm sending my kid. I don't need a coach to convince me to send my kid.

What the new rules have done is force coaches to make their program attractive. I hate this but also keeping players happy. If a player is unhappy they know they have options. I don't agree at all but this is what things is turning in too.
