A Commonwealth Court panel ruled unanimously that the State Employees' Retirement Board wrongly concluded Sandusky was a Penn State employee when he committed the crimes that were the basis for the pension forfeiture.

The judges said the board's characterization of Sandusky as a Penn State employee at the time those offenses occurred was erroneous because he did not maintain an employer-employee relationship with the university after 1999.

I guess Pennsylvania doesn't have a law that stipulates that major major felons lose their pensions. They need to write one, the jerry Sandusky law.

Or extend the statute of limitations for these crimes so that he could have been charged for the pre-1999 molestations.

Or consider his alleged commission of crimes on state property under apparent authority as a PSU employee.

Now that is creepy.Sadly New Jersey only passed a pension forfeiture law a few years ago.

I'm not here defending anyone, I just would like to chime in regarding pensions. If someone in NJ works his or her entire life in the public sector and retires. Are you guys telling me if he or she commits a crime (felony) the state is allowed to repeal their pension?? If yes, I have mixed feelings about this law.

In New Jersey the public pension board is allowed to withhold pension benefits if they were earned by the employee while not providing honorable service to the public.

Do you prefer activitist judges deciding issues on policy grounds and not following the law? If the law stinks, then it is a question for the PA legislature.

Agree.....when did committing a crime mean losing a pension? What's next....he forfeits his social security? Then his investments, Christmas club money, penny jars

If you read the fact sheet, and in practice, it has not been that black and white. More often it has been partial starting from the day wrong doing was proven. The other way is you have a politician or employee skimming for years and walks away with a pension. See Wayne Bryant.

Had nothing to do with the union , it was the court that decided withholding his pension was illegal .
In fact the Pennsylvania Employees' State Retirement System was the one that took his pension away from Sandusky and who fought to keep it from him after he was convicted.

Sandusky has cost the PA taxpayers millions, taking a his pension back will only pay back a sliver.

At the very least while you are in prison you should not get the pension. Send it to the victims or the prison system.

They do and the part dealing with sex crimes was not enacted until 2004. Unfortunately the legal ruling is that you can not retroactively apply laws. I wanted his pension taken away but unfortunately I think the courts ruled correctly on this one. What the court ruled is that the law taking away his pension was not passed until 2004 which was after he was an employee off the university. Therefore they could not retroactively apply it to what occurred when he was an employee in 1998. It make sense in that regard because then it would allow legislatures to create random laws and retroactively apply them to remove pension. For example there is a budget crisis. If they upheld this they could pass a law saying any one civic red of a speeding ticket while an employee forfeits their pension. They could then take away anyone's pension who met that condition.

NJ has their own problems with pensions. Did you know that as a policeman or fireman it is legal for you to collect a disability pension and work in another job? Once you are given the disability pension its never taken away. There are lots of people in the state collecting it and they actually have another job working for the state, so eventually they will be collecting 2 pensions. If I'm not mistaken one of them is on Chris Christie's staff.

In NJ you do. Someone who worked with me got caught stealing $600 and lost their entire pension. They were over 60 with over 25 yrs of service.

This is correct. NJ's statute on this borders on unduly harsh in some circumstances, but it's the right thing to do.

Glad I am not a taxpayer in Pennsylvania.

You are kidding, right? While I certainly wouldn't be thrilled paying Sandusky's pension, I'd much rather be a taxpayer in PA. They are much more rational in what they pay public employees, and as a result don't have the ludicrous property and income tax rates that NJ has. As far as economically and efficiently running state and local government, PA >>> NJ and it's not even close.

They actually get more federal money so they do not pay for what they get

If NJ received the same percentage of federal dollars as Pa. we would have lower taxes also

Gotta love ignorant comments about something you absolutely have no clue about. It had absolutely nothing to do with unions. Sandusky was never in a union. It was a state employee retirement system. The pension board pulled his pension. The courts reversed their decision due to it violating state law.
