I thought about it and have nothing. Can Croom really do that with all the parody accounts?

I know this involves Sylvester Croom, but it seems dumb even for him.

If he wrote the whole thing as if he was pretending to be Crooms and it was clear it was a joke, he'd be safe.

If he simply calls it the Croom diaries and has a normal blog about MSU, I think he runs the risk of Crooms being able to successfully claim his trading off his likeness.

Ironically, the worse it makes Crooms look, the safer he is. He might would even be safe by putting something derogatory in the title, so that it was clear he was not actually associated with Crooms. Not a lawyer though, there's just been a few stories about jackasses making copyright claims that have caught my eye, so take that with a big shaker of salt.

So we'll see what they say. Personally, I think it's a huge stretch to say he's using his likeness in a manner that makes it appear he's associated either our site.

And like someone else said, no different than any of the 1,000,000 parody twitter accounts floating around out there. Surely he can add "this is NOT Sylvester Croom" to his bio and fix it all.

I nominated 3rd and Lance Long, The Artist Formerly Known As But Not Associated With Directly The Croom Diaries, amongst others, haha. Lots of good suggestions made to him on twitter

I could see where the absence of a disclaimer Or other indicia of parody could create liability [i have no idea what he posts/writes about], but a simple disclaimer saying "not associated with nor authored by Sylvester Croom" would be clear enough to solve the problem. I think it's a fight this guy would definitely win, but the question is whether it's worth fighting over. I would say add a disclaimer and fight.
