I think your assumption may still be right on the money. It appears that NDA's given to the victims contemporaneously with their trips to Pedo Island or Epstein's other homes (or perhaps one of Trump's homes) would NOT be enforceable because they would be regarded as "pre-dispute NDA's."

But NDA's signed in the context of a settlement of a sexual harassment or sexual assault claim (i.e., "post dispute NDA's") would appear to be enforceable as long as applicable state law did not preclude them from being enforced.

Edit: But most NDA's that I have prepared or reviewed contain an exception that allows either party to the NDA to discuss or disclose matters they would otherwise be obligated to keep confidential, IF their discussion or disclosure of such otherwise confidential matters is done in response to subpoena or other legal compulsion. So if a victim who is party to an NDA that had such a provision is called to testify before Congress or in a trial of some sort, then even a "post-dispute NDA" might not prevent discussion or disclosure.

A few things to this point, and funny enough I agree with piggy in some ways (shocker, plus he has me on mute cuz he such wil baby so he wont' see it anyway):

- The trump admin is stupid af, and there is no 5d chess

- Very few of the allegations in this most recent dump will ever be proved, and probably can't be

- They deleted those files LITERALLY for liberals to obsess over and think they have a gotcha. We don't have proof no matter how bad we want them to be true (this is why it's not 5d chess- its pretty clear they deleted them purposely. They knew they would be released. Don't take the bait).

- EVEN IF any of the allegations were proven, it would change nothing. MAGA is so in bed with Trump and will literally defend anything and everything by him, it doesn't matter

- Trump is a pawn at this point by his admin anyway. He's a poopy pants lame duck who is getting put up with by his staff but they are running the show. Ironically it's no different than their allegations about Biden

- At this point, the files released today are just another distraction away from the massive L Maga took in Minnesosta this week, ICE changing tactics, etc.
