What do contracts mean?

I have to think that is not going to stand up to appeal. You just have to remember that it's Texas and it's a very silly state. I can't see how a school can claim "sovereignty" and get out of all it's contracts since a state itself can't even get out of contracts. This seems to me like TTech is cutting off it's nose to spite it's face. Would you want to coach there knowing they #%#@@@ the last guy out of his contract?

I don't know the details of the claims of the suit, because I don't give a **** about Texas Tech and even less about a total dispshit like Mike Leach. But if you are going to call the State of Texas silly for the laws and rulings that the federal government has had and ruled on since it's inception, take a look at some of Mississippi's laws first.

Sovereign immunity is a fundamental principal of American law. You can't sue a sovereign, or an entity of a sovereign, unless that sovereign gives you permission. If you hear about someone suing the state or one of it's entities, it's because it's usually been done pursuant to a statute. For example, you can sue certain federal entities for certain things under the Federal Tort Claims Act.<div>
</div><div>My brother lives in Lubbock, and I love to hear him talk about all of their fans. They %!%!%*% hated OM after the Cotton Bowl, and most of them were furious when TT fired Leach. He may not be the best coach in the whole world, but that program was **** before he got there, and all he ever did was win. There's a great pic of a group of people protesting his firing with a chubby white guy hold a sign that says "muTiny" and the T is the Texas Tech symbol. I'll see if I can find it.</div>

I didn't say that Texas invented sovereign immunity and I didn't call them silly because of that. I called them silly because Texas has been on a bender the past 10 years or so with attorneys and judges misapplying the law to try and do something that ultimately get's overturned once it reaches a federal court of appeals.

While Ole Miss turns out a lot of lawyers, you obviously aren't one of them. I was referring to the fact that a state can not use sovereignty to get out of a contract. It's been tried and ruled on before. It's the reason the states are so screwed right now, because they cannot declare bankruptcy in order to get out of the contracts they have on the books. They wouldn't need to even look at that step if they could simply say, "we won't honor that contract, and you can't sue us!"

And while the STATE has some rights to deny a lawsuit I seriously doubt that extends down to a college just because it is funded by the state.

Big Lobbying saw to that.

AT&T and all the big banks egregiously violated their contracts, just to name a couple from the last decade. Lawsuits went nowhere.

Nothing new here, just indicitive of the America we've become.

The court never reached the merits of Leach's beef. The court ruled that Leach is barred from suing TT for money damages under sovereign immunity. Your suggestion that Leach should introduce the exception known as promissory estoppel would be like me showing up at a fishing rodeo with no boat, no gear, no license and no entry application. I could protest all I wanted that I can fish as good as anybody in the rodeo, but I would be barred from participation because I didn't follow the rules for entry.
