If he touched her, that's simple assault unless he was acting in defense of himself or others. The least touching can be grounds for an assault charge. If the police had believed she was seriously injured, they would have charged aggravated assault.

Assault requires intent. Simply touching someone is not assault. Otherwise NYC courts would have a million year backup from the strap hangers, not to mention the customers waiting on footlongs and RU gossip at Subway.

And just as obviously the police get things wrong all the time. We may never know for sure what really happened. Hopefully the victim turns out to have been confused and Carroo didn't touch the victim.
