one of our beloved readers sent me the following:

You know that story that was in the Clarion Ledger from Steve (Andy Kennedy's brother)? This is how it started

"The team had its normal team meeting at about 11 p.m. and then the coaches went out for a late-night dinner with some friends that Andy had when he was in Cincinnati. <span style="font-weight: bold;">After they were done, they were leaving dinner and hailed a taxi.</span>"

No dipshit. It doesn't matter what the valet says on TV. What matters is if the guy decides he wants to go to court and testify. The counter-suing thing encourages him to keep his nose out of it and not testify if it comes to that.

Again, I have no clue what happened, but I'm guessing that this whole move by Kennedy's lawyers is just that, an attempt to get Mohammed to drop his charges and if he doesn't drop the charges, it's an attempt to at least keep a witness from testifying. The lawyers wouldn't tell you that's what it is, but that's what it looks like to me.

Maybe it doesn't involve a cabbie and a valet, but people get treated like crap and get treated wrongly everyday. The difference is most people don't escalate the situation to the point where they get arrested. Most people would have called the cab company the next day and complained to his boss and tell them that they are never using their company again.

Ole Miss has a basketball coach, that while he is a very good coach, he is also immature and foolish. There's no two ways around that. Heck, even Bobby Knight never managed to get arrested, to my knowledge anyway. Regardless, I don't think the "Ole Miss lawyer coverup" is going to work this time without the good ol' boy system to help them out this time. And it's about damn time.

part is, he's not joking. another thing that wsa brought up last night in the interview with his agent that i thought was funny was that the agent kept saying how they cabbie and valet weren't credible because they kept changing their story...yet the story he (the agent) gave on what happened was different than what ak had said.

Apparently, threatening witnesses is an acceptable legal maneuver in Oxford.

By not filing criminal charges, it prevents the cabbie from pleading the fifth. In criminal proceedings, discovery is much more limited. Thus, by filing the civil suit, Kennedy's lawyer gets to depose both the cabbie and the valet guy.

Did the cabbie attack AK's fist with his face? You, Rebels, are something else.
O.J.'s "innocence" was more believable than the garbage that you Rebs spew. One problem though ... I don't know if AK can use the race card in Cincy to get his "justice".

Please don't try to shovel that "lying cabbie, lying valet, lying cop vs. choirboy bar .... uh, dinnerhopper" story to me.</p>

Wait, is Kennedy a Cincy District Attorney on the side? If not he can't file criminal charges against anyone. Do you know how the justice system works or are you just talking out your ***?

I don't know who his attorney is. But, this move wreaks of one of the big trial lawyer OM athletic boosters who really don't know how to practice law, but are more skilled at ranting and raving and extorting money.

Sometimes, you are better off to quit pissing people off, even if you didn't do anything illegal. </p>

Well the cabbie isn't a district attorney either. I think you know what I mean, but thanks for looking hard enough to find something to retaliate. It wasn't unexpected.

As for the post from the metal guy, I guess he could make up a charge too. Apparently witnesses only matter if you're a cabbie.</p>

"Threatening witnesses" by filing counter suit is perfectly acceptable everywhere. It's a valid legal maneuver. Like it or not, there's nothing shady, unethical or illegal about it. I'm not saying he's got a good claim, but it's at least a shrewd legal move. Looks like he's serious about his defense and puts some pressure on the complainant and the valet to put up or shut up.

Threatening witnesses may or may not be illegal, but it is guaranteed 100%, without a doubt UNETHICAL. I think that it's funny to mention ethics and lawyer in the same sentence though. If you don't think threatening a witness is unethical, I don't think you understand what the word means.

Exactly my point. Essentially, Kennedy is trying to say that he's not full of ****, and he's trying to put pressure on the valet and cabbie to reconsider whether or not they think their stories are solid enough to win the suit.

If you're the cabbie, and you feel like you haven't made anything up, then you should be able to proceed without concern for losing the case or losing a defamation suit. However, if you've bent the truth at all and you're at least somewhat at fault, then I would think a defamation suit would pretty quickly make you re-think whether or not you want to proceed with the case.

It's just posturing, and in a way it does serve as a threat to the witness and the cab driver to either put up or shut up.

I'm not sure if you missed it, but I agree with that. I've said all along that I've been expecting for something like this to happen to AK, though I was thinking it would be a caught with 2 naked co-eds or a DUI instead of an assault charge.

Essentially, if you push that envelope enough, something is eventually going to happen.

I hope the judge awards them a LARGE punitive settlement from AK for filing a frivilous claim in addition to court costs and attorney fees. Unfortunately, judges rarely award the defendant even if they win. However, most of these cases are the poor suing the rich, not the rich suing the poor, so who knows.

Ethics, as applied to attorneys, are defined by the bar. Filing counter suit in this fashion a perfectly acceptable and very widely used practice. If you don't like it, or it violates your own personal ethics, that's a totally different story. You are the one who doesn't seem to have a grasp of the meaning of ethics here.

Why would you hope that? Is your hate towards Ole Miss so much that you want AK to suffer?

Let's just assume AK knocked the fire out of him. Let's assume he called him Saddam, Osama, etc.

Is that worth a LARGE punitive settlement?

It's funny how folks always want to badmouth a lawyer about being "sleazy" or "underhanded" until they need one. When you're in need of a lawyer, you want or even DEMAND that they go all out and do whatever it takes to win.

Having grown up close to Andy Kennedy, every time he got into some sort of trouble he always blamed someone else. And by knowing him so well and how he is, there is no question in my mind that he guilty of doing what the cabbie is accusing him of. I've seen him do this type of thing so many times. Hell , this is why he got his *** kicked on Frat row at MSU back when he was in Starkville for his recruiting visit back in 1986. Also, the Ole Miss spin machine will lie and deny to no end, just like they did when Goldie was caught with his new truck. This case will never go to trial because the Ole Miss spin machine will pay the cabbie off. I guarantee you he had no idea who Andy Kennedy was from Adam. Andy has always had a terrible temper and attitude and his brother can try to spin it all he wants, but he is guilty!
You just had to grow up with this guy to understand that his attitude + cockiness is his fatal character flaw and boy he can drink whiskey with the best of them! And back in the day, smoke left handed cigarettes with the best Cheech&Chong's of the world!

Sounds like you're describing a protection racket. "Nice family, sure wouldn't want anything to happen to them". No, I can still despise lawyers as much as I despise College Professors. You "need" both, but they're to be used like a toilet plunger (or a ******** for women), cleaned up, then put away until you need them again.
