Again, I have no clue what happened, but I'm guessing that this whole move by Kennedy's lawyers is just that, an attempt to get Mohammed to drop his charges and if he doesn't drop the charges, it's an attempt to at least keep a witness from testifying. The lawyers wouldn't tell you that's what it is, but that's what it looks like to me.

part is, he's not joking. another thing that wsa brought up last night in the interview with his agent that i thought was funny was that the agent kept saying how they cabbie and valet weren't credible because they kept changing their story...yet the story he (the agent) gave on what happened was different than what ak had said.

By not filing criminal charges, it prevents the cabbie from pleading the fifth. In criminal proceedings, discovery is much more limited. Thus, by filing the civil suit, Kennedy's lawyer gets to depose both the cabbie and the valet guy.
Did the cabbie attack AK's fist with his face? You, Rebels, are something else.

I don't know who his attorney is. But, this move wreaks of one of the big trial lawyer OM athletic boosters who really don't know how to practice law, but are more skilled at ranting and raving and extorting money.

Well the cabbie isn't a district attorney either. I think you know what I mean, but thanks for looking hard enough to find something to retaliate. It wasn't unexpected.

"Threatening witnesses" by filing counter suit is perfectly acceptable everywhere. It's a valid legal maneuver. Like it or not, there's nothing shady, unethical or illegal about it. I'm not saying he's got a good claim, but it's at least a shrewd legal move. Looks like he's serious about his defense and puts some pressure on the complainant and the valet to put up or shut up.
Threatening witnesses may or may not be illegal, but it is guaranteed 100%, without a doubt UNETHICAL. I think that it's funny to mention ethics and lawyer in the same sentence though. If you don't think threatening a witness is unethical, I don't think you understand what the word means.

If you're the cabbie, and you feel like you haven't made anything up, then you should be able to proceed without concern for losing the case or losing a defamation suit. However, if you've bent the truth at all and you're at least somewhat at fault, then I would think a defamation suit would pretty quickly make you re-think whether or not you want to proceed with the case.
It's just posturing, and in a way it does serve as a threat to the witness and the cab driver to either put up or shut up.

I hope the judge awards them a LARGE punitive settlement from AK for filing a frivilous claim in addition to court costs and attorney fees. Unfortunately, judges rarely award the defendant even if they win. However, most of these cases are the poor suing the rich, not the rich suing the poor, so who knows.
Ethics, as applied to attorneys, are defined by the bar. Filing counter suit in this fashion a perfectly acceptable and very widely used practice. If you don't like it, or it violates your own personal ethics, that's a totally different story. You are the one who doesn't seem to have a grasp of the meaning of ethics here.

Having grown up close to Andy Kennedy, every time he got into some sort of trouble he always blamed someone else. And by knowing him so well and how he is, there is no question in my mind that he guilty of doing what the cabbie is accusing him of. I've seen him do this type of thing so many times. Hell , this is why he got his *** kicked on Frat row at MSU back when he was in Starkville for his recruiting visit back in 1986. Also, the Ole Miss spin machine will lie and deny to no end, just like they did when Goldie was caught with his new truck. This case will never go to trial because the Ole Miss spin machine will pay the cabbie off. I guarantee you he had no idea who Andy Kennedy was from Adam. Andy has always had a terrible temper and attitude and his brother can try to spin it all he wants, but he is guilty!

Sounds like you're describing a protection racket. "Nice family, sure wouldn't want anything to happen to them". No, I can still despise lawyers as much as I despise College Professors.
