Interesting decision, based on the summary i read (full disclosure, i did not read the opinions as I suspect no one else here has).
1. Note for the nonlawyers - Ny is really weird in that their "supreme court" is not the highest court in teh state, so this is the decision of an intermediate appellate court.
2. From what I understand, they upheld the basic theory of the case under the statute in question, and the conclusion that trump had in fact violated the law based on that theory.
3. But, they struck down the $400M penalty under the 8th amendment (cruel and unusual punishment, excessive fines). note that this could eventually create a federal hook, though i'm sure it's not the only constitutional defense they asserted/could assert
4. Presumably both sides will appeal to the NY Court of Appeal (the state's supreme court), though I wonder a bit how that case will be processed given that he's now in office as the president.
5. I have no view on the merits of the state law question or the judgment. On the excessive fines issue, the clause definitely applies to the states following Timbs v Indiana, and my guess is that if they can overturn taking a guys' land rover for selling some horse, there's a good chance they'd overturn a $400m fine for fraudulent valuations where the lenders received their loan repayments.

Was watching an analysis of the ruling and apparently that next court step is the review of the charges and the moves that will probably throw the whole case out based on the use of Mrs. James interpretation of what the laws meant or intended to be used.

Records and testimony suggest otherwise: James not only allowed her niece, Nakia Thompson, to live there without paying rent, but also covered the property’s maintenance costs herself, meaning she was losing money, not profiting from it.

Thompson reportedly told a grand jury about these details, but Trump’s former attorney Lindsey Halligan chose not to have her testify before the grand jury that ultimately indicted James.

Why? Likely because if the niece’s testimony had been presented, it likely would have undermined the case for indictment entirely.

You should be disgusted by how this ridiculously corrupt administration is abusing their power dude, this is not ok. Presidents shouldn't demand that their AGs maliciously prosecute their political enemies for solely revenge purposes. But if this prosecution is fair, why aren't Scott Bessent, Lee Zeldin and Sean Duffy being charge for the same reason?

They are abusing their power in a cruel and incompetent way and they will not get away with it. Bondi and Halligan will be disbarred at the very least and Trumpaloompa will spend the rest of his miserable days in courtrooms, and god willing, jail.

B*tch can you read? There are two posts above you, one from a respected conservative journalist ,that claim her niece was living in the house rent-free and Letitia was paying for the maintenamce on the property which means it wasn't an investment property. It was alo revealed that Halligan wouldn't allow her to testify before the grand jury because she knew it would sink the case. That's a hell of a lot more evidence than the corrupt regime gave to justify her indictment.

well, the first one is that this prosecution is politically motivated....remember it was James that ran her campaign on the mantra of getting/bankrupting Donald Trump. Trump used the same politically motivated argument (both are probably right). There are others, but I do'n have time now..off to church
