I believe sports participation is set by state school activity associations and the NCAA for colleges. Legislatures and Congress have historical been reluctant to get involved.
I don't think naturally born men should participate in sports with naturally born women - at all. The competitive spirit of it all is broken, which renders the whole thing moot.
That said when I looked at the numbers there's like an average of 2 dudes doing this per state. So while I don't agree with it, its way the **** down my list of priorities. The NCAA number was recently 10 out of 50k athletes. The complaint about legislatures and Congress is that they monkey too much with things. Some want to add management of HS athletics to the list for a number of kids that would fit in a school van.
