With my background in LE, my opinion is silence is almost always your best friend. The temptation to want to give "your side" can be strong, especially if you see your reputation taking a giant hit. I love this scene in Mr. Between where two police officers are trying to question Ray at his house and the only answer he gives to all of their questions is, "I don't answer questions." The scene is pretty funny.

The Aussies put out some good series.

yes facts do matter at the end of the day but to say we cant allow people to come forward despite any perceived proof needed and as far as any case sure some are false allegations ..... but it is a very low percentage to begin with..... as far as having your life destroyed well if you didn't do it what would need to be worried about right? sue for defamation AFTER you have been cleared right?

View attachment 828532
Two wrongs don't make a right. This is also unacceptable. While false accusations are rare, consequences are severe and corrections ttake many years when they even happen.

Austin Scott was cleared of rape charges but lost his shot at the NFL, and years later had his lawsuit thrown out of court. But apparently he shouldn't have been worried.

Our system should enable juatice for victims while preventing victimization of innocent people. Both.

No charges being filed would mean he's cleared to me . Now those could come down the road PA statue of limitations is 12 years . And if they never do that would clear him

Thanks for linking the article. I had never heard of that case until now. I wanted to point out one thing regarding claims of SA where the victim has very little, if any, recollection of the event. When someone has a "blackout" event others often equate that with someone who had passed out and therefore was incapable of giving consent, especially regarding sexual activity. They are very different things. Here is an AI summary regarding "blacking out":

Blacking Out (Alcohol-Induced Amnesia):
    • Definition: A period of amnesia where a person is awake and seemingly functional (talking, walking, etc.) but has no memory of their actions or experiences during that time.

    • Symptoms: May not have any noticeable outward signs beyond the lack of memory recall.

    • Cause: Primarily associated with high levels of alcohol consumption.

    • Duration: Can last for hours, even if the person appears to be awake and active.

    • Dangers: Risky behaviors, such as driving or engaging in unsafe sexual activity, can occur without the person's awareness, potentially leading to serious consequences.
An intoxicated person may engage in voluntary behaviors and potentially wake up the next day with no recollection of the events. They may even be adamant that their actions were forced or coerced. These types of potential SA-allegation cases are notoriously difficult to assess where the truth lies. Often times outside evidence (e.g., video of both parties leaving a bar shortly before the alleged SA, contemporaneous text messages or phone calls, third party statements, etc.) help clarify if a crime may have occurred. The bottom line is when drugs and/or excessive alcohol consumption are involved with sexual behavior then some very poor outcomes can occur that may haunt either or both parties for years.

Yeah that's the answer......way to silence even more women. Do you even comprehend what you just said? Lets let males continue raping women or shall we say exploit them in various ways with no defense to fight back? If their only recourse is to come forward and we shut them out because they didn't obtain proof? Really??? all the trauma and yet on top of all that... they have to also be thinking and calculate in the moment.... I better get proof else I was just asking for it? That's your stupid a$$ take? you do know.. No means No
I am not sure why you think it is such a an absurdity to have proof of your accusations when you make them when or if possible. If you don't have proof personally but know it happened to you then you file a report with the police and they dig up the evidence. It's not too much to ask that someone making accusations of illegal activity should file a police report in concurrence with making accusations. You're straw-manning here and it's to generate a response. Our justice system is innocent until PROVEN guilty. Sadly for the women who never find justice, their lack of justice does not cancel out everyone else's presumption of innocence. IF someone is falsely accused and can prove that, they should file a lawsuit. Now, in a lawsuit there would be discovery and unless Carter is 100% innocent and has no other skeletons he should stay away from that. We still know almost nothing factual. Let's keep waiting and holding off on judgement.

No matter how everything shakes out with these allegations, I sure don't think Beau's wife is doing him any favors by continuing to get into these types of conversations on social media.

Yeah, I'm all for free speech, strong women, blah, blah, blah. However, sometimes it's better to have counsel to advise both parties to stay the hell off of social media. Just like a divorce, it's just not wise to go down this road. It's not being silent, it's being intelligent.

agree but we cant let decades if not hundred years worth of attitudes and behavior prevent women from coming forth.

Release a statement regarding what exactly? A former student athlete and spouse having a one way public spat with another former student athlete?
No, about the multiple wrestlers (some of whom may be current wrestlers for all we know) accusing Starocci of a variety of forms of sexual misconduct, and that at least one of them specifically reported the sexual misconduct to the coaching staff.

No matter what actually happened, this is an orchestrated hit piece designed to damage on particular person's reputation. It can be all true, partially true or mostly false to all BS.

The problem is the timing and linking together all of the alleged behavior. 1. the allegations of theft. Very believable, but if you think the cops actually solve these cases you're delusional. If you're lucky you get your stuff back. I have dealt with a contractor who failed to do the work and was robbed of $2500 and two cases of bad tenants who caused damage while doing illegal things in the apartment. Think I recovered any $$$ or they were jailed? Nope, well one was maybe but she's dead now. Heroin is a helluva drug.

2. Alleged gross locker room behavior? What was told to the coaches when? What measures did they take to address it if any? Who knows? I need to see what steps were taken prior to believing this. One person her or the other sight mentioned about addressing employees and how that conversation is between them. And of course the aggrieved party still sees the same behavior. Remember the accused has rights. One example is a very large women at my wife's job who displays a lot of cleavage. The ladies grumble because it's inappropriate but no one does anything. Big fat gals have extra leeway I guess?

All of this together makes me less likely to believe 3. I was falsely accused once so it does happen. Ask the Duke Lacrosse team, Trevor Bauer, and many others. People lie about this stuff.

3. Alleged sexual assault. Someone here posted that app 90% of sexual assaults are not reported. This is what is called ********. The number is unknown. That figure comes from anonymous surveys, the least accurate form of data collection. Here's how it works: Some grad student sends out x number of survey sheets with various types of actions that can be classified as SA. Say they send out 500 questionnaires? They take the surveys that come back, calculate the positive response and come up with a % that is pure speculative BS. There is no way to really know the number.

Now what do they define as sexual assault? Is it any non consensual touching of no no parts? Chest, butt, or front stuff? Well guess what? I've had women all do that to me without my consent. I just walked away because I was in no danger, however I'm not going to consider that SA. Some will.

The actual number I've heard is that initial contact with LE are 70% and up BS. Yes, the stories fall apart immediately. Some will have legs of course and that will lead to an investigation which does not guarantee they will find enough to arrest and indict. You need evidence and making some claim years later when you have a dating/hook up history is near impossible to prove at a conviction level. If you see evidence of an affair with things such as texts, gifts, hotel receipts and pictures you might be able to prove something civilly. However dating or an affair is not illegal. Timing is very important so immediate reporting, or actual evidence you told someone will be needed to prove your case.

If for example you told a therapist, priest, or doctor but did not want to have them report a crime, that might help. And then you have the issue of mandatory reporting which I'm not sure would apply here? Maybe the victim does not want to cooperate. I was told many people in the Sandusky case didn't want to come forward to testify or claim damages.

So I'm here, I would not Trust Starocci around my stuff or female friends and relatives. Why tempt fate? Also I would not trust Beau or his wife to work in any business I own nor would I recommend them to anyone based on what I'm seeing here. They've shown poor judgment at the minimum. Continuing to carry on and digging their heels like this does not make them more believable. If these women were assaulted, file police reports and get it on. But by continually to double down too me says you're very likely exaggerating at a minimum. Call the police and file a report already.

But I doubt that happens, discovery goes both ways and any amateur detective work might appear to be collusion opening people up to some potential problems.

Starocci's mouth has hurt him with these allegations. I mean his history on social media. Staying quiet is probably the best advice here and if it rises to the level of criminal conduct, then report or file a civil suit.

Us software developers are binary (If ‘yes’, do A, else do B, adding nested if/else’s at every turn).

IF Beau or anyone else files SA charges resulting in Carter’s guilt
…..Punish Carter to fullest extent of the law
…..IF Cael or staff are implicated in covering up any SA
………Fire them
…..ELSE
………Do nothing (though Carter’s conviction stains them plenty)
ELSE
…..Carter is presumed innocent (similar to AJ)
…..Regardless of guilt, CS reputation takes huge hit
…..Cael and staff reputation suffer as well

Given the article, I’d be surprised if charges aren’t filed, though they would’ve had more teeth closer to the SA itself (for evidentiary purposes alone).

This is just wrong , those that have been proven to file false accusations don't have downside risk , just look at the dodgers pitcher or the Buffalo bills punter who proved they were innocent . Both suffered from the accusations and the women who falsely accused didn't nearly suffer as much. The fact is there isn't enough punishment for those who falsely accuse and until that is fixed you will continue to have too many cases of women falsely accuse.

Ah! Brings back memories of programming in BASIC on the Radio Shack Trash-80 in high school! DIY Centipede using character-based graphics!

Your last two instructions do not belong in the else block; they need to be top level. Because even if (especially if) Carter is charged and found guilty of SA, Carter’s and Cael’s and the staff’s reputation will take a hit. 😀

What part of what I wrote discredits the idea of false accusations being a real issue or that if one is made they shouldn't be punished? I agree with you that those who falsely accused others deserve severe punishment. I didn't say otherwise.

The problem with this when law-enforcement deals with these things, the yes or no often becomes maybe. Like we do not have anything here to go forward with.

All my friends and family who are lawyers all have their clients have someone take over their social media accounts and change the password until the court case is over. It's the worst place to go to vent or try and set the record straight.

Well, there's at least 2 sides to every story, and we've only heard one. Eventually, and most likely not long from now, the other folks will speak or things will leak out.

Well, the lawyers are, in theory, going to advise clients to do things the lawyers believe are in the best interests of their clients. Which, although they usually are, sometimes may not be the things that are actually in the best interests of their clients. Obviously there are plenty of different ways to end up in court, but if the other side is essentially trying their case in public, depending on the situation, there are times when responses or proactive information could be helpful to the clients.

Cael put together a massive statement addressing and refuting everything immediately after the Collegian article came out. The University would not sign off on releasing it which I'm sure did not sit well and continues not to sit well as these people are just taking free shots at him publicly. I will be pretty surprised if there are not lawsuits moving forward.
