"Clemson already has a lawsuit ready for filing but are waiting to hear the ACC’s response. I thought they were going to file today, but they’ve decided to hold off for the time being to decide what their counter arguments should be.
UNC was always planning on waiting for counter arguments as NC doesn’t have the same state laws protecting it that FSU and Clemson do, so they are going to need a different strategy.
Additionally, the SEC is more likely to work with the GOR given that the SEC and ACC have the same primary partnership with ESPN. FSU and Clemson are preparing for B16 membership (applying for AAU membership, investing heavily in transportation, investing heavily in research, etc.) and are planning on challenging the GOR.
Boo Corrigan likely switched to allow in SMU/Stanford/Cal to allow FSU/Clemson/UNC use the legal arguments of gross incompetence and mismanagement of brands. Boo also likely opted to keep FSU out of the Playoff to stoke the fire and guarantee NC State has a landing place during the fallout, hence why I believe State gets a comfy seat in the SEC.
FSU and Clemson are both making plays to move to the B16 and are showing their commitment. The B16 isn’t going to give an offer as long as the GOR is still in effect. Both will gladly take half the money for the first couple of years. Fox and the B16 commissioner have made it clear they’re interested in moving into the Southeastern market and run the B16 like a pro league, having television markets everywhere but also games on constantly in all regions. Clemson is willing to put forth more of an effort to compete and recruit nationally, as well as invest more money, than Miami is. I believe Miami will be in the B16 in the last stage of the expansion (either Miami or Pitt, whoever is willing to spend more money) along with GT, with GT actually looking to raise the money to make it happen. Before that happens, when the conference becomes very unstable and the big brands announce they’re leaving, NBC is going to announce they are out as ND’s future scheduling viewership is going to be severely affected with them playing subpar teams for half of their schedule. ND is going to be forced to actually join a league, and I believe it will be the B16 and they bring in Stanford.
The SEC has made it clear they want UNC and UVA. ESPN will likely make this happen and wave the GOR when FSU and Clemson leave instead of fighting a legal battle. UVA will need VT per state law, and the state of Va is not willing to budge on this. I believe NC State solidified their place as part of an agreement to put in Bama. What happened was a huge controversy no matter how many echo chambers ESPN sends out saying otherwise, which is part of why the ACC is going to dissolve, and this IS going to come up in court.
This is why I have stated how I see everything shaking out. What IS known:
FSU HAS filed.
Clemson WILL file, likely before the end of the year, although the bowl game may influence this. I expect it to happen before the end of the first week of January at the latest.
UNC WILL file. They are going to wait and see what the ACC does, and wait until the ACC already has their hands full, and then throw the final uppercut after FSU and Clemson give them the ole’ 1-2.
Miami HAS NOT filed or invested the money/resources for a legal battle (yet).
UVA HAS raised the money and are going through the legality of leaving, but they’re connected to VT legally on a state level, so it will require both to leave or the conference to collapse, so they will be leaving later. This has really complicated their plans.
ND DID NOT join the ACC in football. If they had, all of this would have been moot. This is what FSU (and Clemson and UNC consequently) was actually waiting on. The snub was just icing on the cake and fodder for the cannon."
