It seems that Michigan's defense of their behavior is that coaches share information, which is tantamount to what they did. If that's the case, then why not just get the information from another coach? Why engage in a sophisticated clandestine off the books program to steal signs?
The two acts must not be the same in terms of what information is gathered, otherwise why would Michigan put themselves in a position where they're clearly violating the NCAA rule and open to discipline.
